Mumbai: The Aurangabad bench of the Bombay High Court just recently enabled a male founded guilty of power burglary to take a trip abroad for the Haj expedition, keeping in mind that his charm versus the sentence is not likely to be listened to in the future.
Justice Abhay Waghwase allowed 43-year-old Rahim Khan Sandu Khan, founded guilty in October 2016 under the arrangements of the Indian Electricity Act for power burglary, to take a trip for the spiritual expedition from April 2025 to September 2025.
“As the criminal appeal (against conviction) is of the year 2016, and there is no immediate chance of appeal being taken for hearing, for religious purpose, application deserves to be allowed. Applicant is allowed to travel abroad from April 2025 to September 2025,” the court claimed.
The court enforced problems, highlighting that Khan need to offer a task not to abuse the freedom approved. “Applicant shall furnish his undertaking of not misusing the liberty and shall supply details and itinerary of his journey, tickets and its dates, details of airlines, details of accommodation at Saudi Arabia, and also furnish details of the properties owned by him to the concerned police station and this Court, prior to his proposed pilgrimage,” Justice Waghwase routed.
Khan, a business owner, was scheduled for power burglary in 2007 and punished to 2 years behind bars by a sessions court in 2016. He tested the sentence in the High Court the exact same year. On October 25, 2016, the High Court approved him bail and suspended his sentence pending the last hearing of his charm.
Through his application in the possible charm, Khan looked for approval to take a trip abroad for Haj, suggesting that his charm was not likely to be listened to quickly which the expedition was a mandatory spiritual responsibility.
Taking note of these entries, the court approved his demand, specifying: “In view of the grounds raised in the application, and as appeal is of the year 2016, and there is no immediate chance of appeal being taken for hearing, for religious purpose, application deserves to be allowed. Hence, the following order. Applicant is allowed to travel abroad from April 2025 to September 2025 is hereby granted on following condition that Applicant shall furnish his undertaking of not misusing the liberty and shall supply details and itinerary of his journey, tickets and its dates, details of airlines, details of accommodation at Saudi Arabia, and also furnish details of the properties owned by him to the concerned police station and this Court, prior to his proposed pilgrimage.”
