Chaturvedi was taking a trip with his family members from Katni to Durg, when the burglary happened around 2:30 am. Despite taking required safety measures, “outsiders” had the ability to get in the scheduled instructor because of the oversight of the Train Ticket Examiner (TTE), resulting in the burglary of cash money and belongings worth Rs 9.3 lakh from his bag. Chaturvedi immediately submitted an FIR with the train authorities after the event. The NCDRC ruled that the Railways was responsible for the violation of safety and bought the payment of Rs 4.7 lakh, holding the authorities in charge of the oversight that resulted in the burglary. This choice stresses the Railways’ responsibility in guaranteeing guest safety and security and safeguarding their personal belongings throughout traveling.
In its support, the Railways suggested that under Section 100 of the Railway Act, it is not responsible for any type of loss of baggage unless it has actually been formally scheduled and an invoice released by train personnel. However, the National Consumer Disputes Redressal Commission (NCDRC) disregarded this disagreement. The NCDRC ruled that the Railways have a task to make sure the safety and security and safety of travelers in scheduled instructors. Chaturvedi had earlier submitted an issue in the Durg District Consumer Commission in this issue, which bought the train authorities to pay payment. The trains tested this order in the Chhattisgarh State Consumer Commission, which denied the order of the area compensation. After this, Chaturvedi submitted a testimonial request in the NCDRC, where the judgment was ultimately given up his favour.
